These Terms of Service ("Terms") govern your use of margaretscott.com (the "Site") and any purchase you make from Margaret Scott ("we", "us", "our"). By using the Site or placing an order, you agree to these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method you supply.

2. Accounts

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.

3. Products, pricing, and availability

All prices are in U.S. dollars and are subject to change without notice. We work to keep product descriptions, imagery, and pricing accurate, but we do not warrant that all content is error-free. We reserve the right to correct errors and to cancel any order placed at an incorrect price, refunding you in full.

Our products are made to order and produced in limited quantities. We may limit order quantities, refuse or cancel any order, and discontinue any product at any time.

Product photography and on-screen previews are representations. Because items are individually produced, and because screens render color differently, slight variation between the preview or photograph and the finished item is normal.

4. Personalization and customer-supplied content

Many of our products are personalized with initials, names, text, or logos that you supply ("Customer Content"). By submitting Customer Content, you represent and warrant that:

• you own it or have all rights and permissions necessary to use it and to have it reproduced on a physical product; and
• it does not infringe any trademark, copyright, or other right of a third party, and is not unlawful, defamatory, hateful, or obscene.

You grant us a limited license to reproduce Customer Content solely to produce and fulfill your order. We may decline any personalization request at our sole discretion, and will refund an order we decline. We are not responsible for errors in Customer Content that you submit, including misspellings and incorrect initials — please review your entries carefully before checking out.

5. Wholesale accounts

Wholesale pricing is available only to businesses approved by us and is subject to order minimums and to providing a valid resale certificate or tax identification. Wholesale pricing and account access are for your business only and may not be shared, resold, or used to purchase for personal use. We may approve, decline, suspend, or close wholesale accounts at our discretion. Shop-branded production is subject to a separate arrangement, and you warrant you hold the rights to any branding you supply.

6. Intellectual property

The Site and its contents — including our designs, product models, text, photography, graphics, and logos — are owned by Margaret Scott or our licensors and are protected by intellectual property law. Our product designs, including pending patents on forthcoming products, remain our property.

Purchasing a physical product does not grant you any right to reproduce, copy, or manufacture it, or to make derivative works from it, whether by 3D printing, molding, or any other means. Rights to produce our designs are available only under a separate written license — contact us if you are interested.

7. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with or disrupt the Site or its security, to scrape or harvest data, to introduce malicious code, or to impersonate any person or entity.

8. Third-party services

The Site runs on Shopify and may use third-party tools and links. We are not responsible for the content, policies, or practices of third parties, and your use of their services is at your own risk and governed by their terms.

9. Disclaimer of warranties

Except as expressly stated in these Terms or required by law, the Site and our products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Our products are craft tools intended for stitching and needlework use; they are not intended for any other application.

10. Limitation of liability

To the fullest extent permitted by law, Margaret Scott and its owners and staff will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or damage to a canvas or project, arising from your use of the Site or our products. Where liability cannot be excluded, our total liability is limited to the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing here limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Margaret Scott from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your violation of any law or third-party right — including claims arising from Customer Content you supply.

12. Termination and severability

These Terms remain in effect while you use the Site. We may terminate access at any time for breach. If any provision is found unenforceable, it will be severed and the remaining provisions will stay in full force.

13. Governing law

These Terms are governed by the laws of the State of Alabama and applicable United States federal law, without regard to conflict-of-law principles. Any dispute will be brought in the state or federal courts located in Alabama, and you consent to that jurisdiction. Nothing here deprives a consumer of the protection of mandatory law in their country of residence.

14. Changes to these Terms

We may update these Terms from time to time. The version posted on this page at the time you place an order governs that order. Continued use of the Site after changes are posted means you accept the revised Terms.
